育児休業法の改正について

育児休業法が改正されます。改正前にしっかりと確認しておきましょう。
１．短時間労働勤務制度と所定外労働（残業）の免除
現行では、3歳までの子どもがいる場合、「短時間労働勤務制度」か「所定外労働（残業）の免除」のどちらかの制度を会社で設ける必要がありました。しかし改正後は、「短時間労働勤務制度」「所定外労働（残業）の免除」がどちらも設けなければいけないこととなります。
２．看護休暇制度
現行では、子どもの人数に関わらず、小学校就学前の子どもの看護のための休暇を年5回取得可能としていました。しかし改正後は、小学校就学前の子どもの人数が1人の場合は5日、2人以上の場合は10日取得可能となります。
３．育児休業の期間
現行では、父母ともに子どもが1歳になるまでの1年間が育児休業の取得可能期間でした。しかし改正後は、父母が育児休業をずらして取得することにより、子どもが1歳2ヶ月になるまでの期間、育児休業を取得することが出来るようになります。
父は1年間、母は産休の期間を含めた1年間（産休は2ヶ月なので、母の育児休業は8ヶ月）取得できます。1人が1年2ヶ月取得することは出来ないので注意が必要です。あくまで期間をずらして最大1歳2ヶ月までです。
４．育児休業の再取得
現行では、育児休業を2度に分けて取得することは出来ません。（一部特別な事情がある場合を除く）しかし改正後は、産休期間内に父が育児休業を取得した場合に限り、再度取得することが可能となります。
５．専業主婦（夫）家庭の育児休業取得
現行では、専業主婦（夫）家庭の場合、育児休業を拒めることとなっていました。しかし改正後は、専業主婦（夫）家庭であっても、育児休業を拒むことは出来なくなります。
この改正は公布日（平成21年7月1日）から1年以内、つまり平成22年7月1日までに施行されます。但し、従業員が100人以下の会社は、１の「短時間労働勤務制度と所定外労働（残業）の免除」のみ、公布日から3年以内、つまり平成24年7月1日までに施行されます。
以上です。法改正が施行されたら会社にきちんと請求できるように、内容をよく把握しておくことが大切ですね。
